These Terms of Service ("Terms") govern your use of the etocky app and services, operated by [TO FILL: legal entity name], Luxembourg. By registering or using the service, you agree to these Terms. If you do not agree, do not use the service.

1. The service

etocky provides a digital wallet and ticketing system for events. You buy digital tokens ("Tokens") to pay for goods and services at participating events, and may buy entry tickets where offered. Tokens can be used only within the service, are not legal tender, bear no interest, and have no value outside participating events.

2. Tokens & top-ups

  • 1 Token equals €1.00. Tokens are issued when you top up and are spent with event vendors.
  • You may top up by card (via our payment processor, Stripe) or with cash at a staffed station. Card top-ups come in fixed amounts (€10, €20, €50); the minimum is €10.
  • Some items (e.g. reusable cups) carry a Token deposit, returned to your wallet when you return the item to a vendor.

3. Service fee

Card top-ups include a platform service fee for providing and operating the wallet and ticketing service — it is a fee for our service, not a surcharge for paying by card. The exact fee is always shown before you confirm payment. Where an event sells entry tickets, a service charge (currently 8%) is added to the ticket price and shown before payment.

4. Refunds & cancellation

  • Cancellation before use (fee-free): you may cancel an unspent card top-up and receive a full refund, with no fee, at any time before you have spent any of those Tokens. This reflects your statutory right of withdrawal for distance contracts.
  • Post-event refund: you may request a refund of your unspent Token balance, with any held cup deposits, until 24 hours after the event ends (the organiser may set a different window). After that, no further refunds are issued.
  • A processing fee of 5% of the refunded amount (configurable by the organiser) applies only to the voluntary post-event cash-out — never to a cancellation made before you have spent any Tokens. The fee and the net amount are shown before you confirm.
  • Refunds are returned to the original card used for the top-up and typically appear within 5–10 business days.
  • Tokens funded by cash cannot be automatically refunded to a card; any cash-funded balance is settled manually by the organiser.
  • Tokens on tickets designated VIP are non-refundable and must be spent at the event, except where mandatory consumer law provides otherwise.

5. Your account

You register with a valid email and sign in with a one-time code (OTP) — no password. You are responsible for keeping access to that email secure. We may suspend or close accounts we reasonably suspect of fraud or abuse.

6. Liability

The service is provided 'as is'. To the extent permitted by law, we are not liable for indirect or consequential losses, nor for the quality, safety or legality of goods bought from vendors with Tokens. Nothing in these Terms limits liability that cannot be limited by law, including mandatory consumer rights or liability for death, personal injury, fraud or gross negligence.

7. Consumer rights & dispute resolution

If you are a consumer, you keep all mandatory rights under Luxembourg and EU law; these Terms do not override them. If we cannot resolve a complaint directly, you may use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr or contact us at the address below.

8. Governing law

These Terms are governed by the laws of the Grand Duchy of Luxembourg. Disputes fall under the courts of Luxembourg City, without prejudice to the mandatory consumer-protection rules of your country of residence.

9. Changes

We may update these Terms from time to time. We will indicate the effective date above and, for material changes, notify you by email.
